Welcome to JomHiking.com. The following Terms & Conditions govern your use of our website and services. By accessing or using our platform, website, or booking services, you agree to these Terms & Conditions. Please read them carefully before making any bookings.
1. General Terms
Eligibility: Users must be at least 18 years of age to book a trip with JomHiking. Minors must be accompanied by a legal guardian or provide written consent.
Booking and Payment: All trip bookings and payments must be made through the JomHiking platform or approved channels. Full payment is required to confirm your booking. Prices are transparent and stated clearly before confirmation, with no hidden charges.
Privacy & Data Protection: Your personal data will be collected, stored, and used in accordance with our Privacy Policy. By using our platform, you consent to this data usage.
Amendments: JomHiking may update these Terms from time to time. Updated Terms will be posted on the platform, and continued use constitutes acceptance.
2. Payments & Confirmation of Booking
- Full payment is required at the time of booking to confirm your spot on any JomHiking hike.
- If full payment is not received by the specified due date, JomHiking reserves the right, at its sole discretion, to cancel the booking or apply a revised rate.
- JomHiking is not responsible for any transaction fees, currency conversion charges, or other costs levied by your bank, credit card provider, or other financial institutions. Such charges are your sole responsibility and will not be refunded.

Booking on Behalf of Others
By making a booking on behalf of other participants, you are deemed the designated Group Contact for all individuals included in that reservation. As the Group Contact, you are responsible for:
- Ensuring all payments for the booking are made in full and on time.
- Communicating any changes, cancellations, or special requests to JomHiking on behalf of your entire group.
- Disseminating all pre-trip information (e.g., meeting details, gear lists, safety briefings) to your group and ensuring their understanding and compliance.
- By booking for others, you represent and warrant that you have obtained the necessary consent from each participant to share their personal information and to accept these Terms & Conditions on their behalf.
Accuracy of Information: You are solely responsible for verifying that all information (e.g., names, contact details, medical declarations) provided for every participant is complete and accurate. JomHiking will not be liable for any errors, omissions, or consequences arising from incorrect information supplied by the Group Contact.
4. Minor Participants (Under 18)
Any participant under the age of 18 on the date of the hike is considered a minor.
A) Supervision & Minimum Age
- Minors must be accompanied and supervised at all times by a parent or legal guardian.
- All bookings involving minors are subject to review and approval by JomHiking at our sole discretion.
- Unless specifically stated otherwise in the hike description, the minimum age for participation on any JomHiking trip is 5 years old.
B) Guardian’s Responsibilities
The accompanying adult (parent or legal guardian) is solely responsible for:
- Ensuring the minor meets all legal, regulatory, and fitness requirements to participate.
- Securing any required consents, travel permits, or other documentation as mandated by Malaysian authorities.
- Verifying that all personal and medical information provided for the minor is complete and accurate.
- JomHiking will not be liable for any fees, damages, or losses resulting from the failure to secure necessary consents or meet legal requirements. We reserve the right to deny participation without refund in such cases.
C) Acceptance of Terms & Assumption of Risk
By completing a booking, the accompanying adult jointly and severally:
- Accepts these Terms & Conditions on behalf of the minor(s).
- Assumes all risks and agrees to all limitations of liability on behalf of the minor(s).
- Is fully responsible for the minor's behavior, safety, supervision, wellbeing, and monitoring throughout the hike.
D) No Childcare Services
- JomHiking guides are not childcare providers. We expressly disclaim any responsibility for chaperoning, controlling, or providing care services to minors.
- The supervising adult maintains full and primary responsibility for the minor throughout the duration of the trip.
5. Hike Participation Disclaimer
This disclaimer outlines the specific terms and conditions for all participants in JomHiking's guided hiking adventures.
A) Personal Data Collection:
Personal Information: Participants’ personal information, including full name, identification number, address, contact number, etc. will be collected during registration.
Purpose: This data is required for the purpose of applying for insurance coverage and forestry permits, as mandated by local authorities.
Name Change Policy: Once a forestry permit or insurance application has been submitted and approved, no changes to participant names are allowed.
This is due to regulations set by the Forestry Department and insurance providers, where permits and coverage are issued under the registered participant’s full legal name. Any replacement or substitution will require a new booking and payment.
B) Eligibility & Medical Conditions
Participation in hikes organized by JomHiking is inherently strenuous and may not be suitable for everyone. For safety reasons, our hikes are not suitable for:
- Children under 5 years of age.
- Individuals over 65 years of age.
- Pregnant women.
- Individuals with serious medical conditions, including (but not limited to) heart disease, respiratory issues, uncontrolled high blood pressure, a history of altitude sickness, recent surgery, or a generally low fitness level.
- Individuals with chronic back problems, vertigo, or a severe fear of heights.
- Individuals with mobility impairments.
- Individuals with severe insect or environmental allergies.
- Individuals who have been scuba diving within 24 hours prior to the hike.
i. Mandatory Health Declaration & Disclosure
A complete and accurate health declaration is mandatory for all participants. You agree to disclose all pre-existing medical or psychological conditions that may:
- Affect your ability to safely participate in the hike.
- Be impacted by travel to remote areas without immediate medical access.
- Adversely affect the experience or safety of others.
You must provide any additional medical information reasonably requested by JomHiking during booking process.
ii. JomHiking’s Right to Assess Fitness
JomHiking reserves the right, at its sole discretion, to deny participation to any individual at any time if it is determined that their physical or mental condition renders them unfit for the hike or poses a danger to themselves or others. Such a denial may occur before departure or during the hike itself.
- Pregnancy is considered a medical condition and must be disclosed at booking. JomHiking may refuse participation to anyone over 24 weeks pregnant.
- Other Conditions: JomHiking may refuse participation where a medical condition presents a significant risk and no reasonable accommodation can be made.
iii. Consequences of Non-Disclosure or Late Information
Failure to provide a complete health declaration or any reasonably requested medical information by the specified deadline grants JomHiking the right to cancel your booking. In such cases, no refund will be given as per our
Refund & Cancellation Policy.
iv. Participant’s Ultimate Responsibility
- Consult Your Physician: You are responsible for consulting with a physician to confirm your fitness for travel and strenuous activity, and for obtaining advice on necessary vaccinations or medical precautions.
- No Medical Advice: JomHiking does not provide medical advice. Our assessments are based on risk management, not medical diagnosis.
- Assess Your Own Capability: You must personally assess the risks and demands of the hike against your own unique circumstances, limitations, fitness level, and medical needs.
- Acknowledgement of Remote Travel: You acknowledge that our hikes may access remote areas where emergency medical care is not readily available and where local medical facilities may not meet the standards of your home country. JomHiking makes no representations or warranties regarding the standard or availability of medical care in these regions.
C) Risks and Hazards:
Hiking activities carry inherent risks which may result in injury or, in rare cases, death.
These risks can be reduced through proper preparation, safety measures, and by following the instructions of the appointed mountain guide (MGP). Participants acknowledge the possibility of hazards including, but not limited to:
i. Fatigue, dehydration, or muscle cramps
ii. Slips, falls, or straying off the trail
iii. Contact with poisonous or thorny plants
iv. Flash floods, landslides, falling trees or branches
v. Encounters with wild or venomous animals
vi. Hyperthermia (overheating) or hypothermia (excessive cold)
vii. Infections or diseases transmitted by animals or the environment
D) User Responsibilities & Prohibited Conduct:
- As a participant, you agree to follow all safety instructions from MGP and arrive on time at the designated meeting point.
- Participants must not engage in unsafe, abusive, or disruptive behavior, nor harass or disrespect other participants or MGPs.
- You agree not to consume alcohol, drugs, kratom, or any illegal substances during the trip.
- No littering allowed. Please keep the trail clean and follow the "Leave No Trace” principles.
- Sharing false information during booking or registration is prohibited.
E) Overtime Charges:
- If a hike exceeds the scheduled completion time due to participants’ delay, slow progress, extended rest periods, or non-compliance with the appointed MGP instructions, the MGP reserves the right to impose an overtime charge.
- The rate will follow the official MGP Association fee or JomHiking’s advised rate, based on the delay duration and manpower involved.
- Participants will be informed of any such charges before or immediately after the trip.
F) Official Communication Channel:
- Once a booking is confirmed, participants will be added to an official WhatsApp group created for that specific trip.
- This group will serve as the primary communication platform between JomHiking, MGPs, and participants.
- All-important updates (assembly point, weather alerts, last-minute changes) will be shared there.
- Participants are responsible for monitoring messages. JomHiking is not liable for missed information if a participant fails to stay updated.
G) MGP’s Authority to Modify, Delay, or Terminate Trip:
JomHiking and the appointed MGP reserve the right to modify, delay, suspend, or terminate a hiking trip at any stage if, in their reasonable judgment, the situation poses a safety risk or violates regulations. This includes, but is not limited to:
- Discovery of false or forged booking information, including a participant's failure to present valid government-issued identification that matches the booking details;
- Participant’s failure to comply with safety instructions or rules;
- Behaviour endangering self, others, or the environment;
- Unsuitable physical or health condition of a participant;
- Adverse weather conditions (e.g., heavy rain, lightning, strong wind);
- Unsafe terrain or environmental conditions (e.g., landslides, fallen trees, flash floods, or restricted access issued by authorities).
- Arriving late beyond the stated cutoff time.
In such cases, the MGP’s or JomHiking's decision shall be final and made solely for the safety and wellbeing of all participants.
No refund or compensation shall be provided for cancellations or adjustments made due to these safety-related reasons.
H) Guide-to-Participant Ratio Policy:
For the safety and proper management of each hiking trip, JomHiking and all appointed MGP will adhere to the official ratio of guide(s) to participant(s) as set by the relevant forestry authorities and associations.
i. Designated Areas Requiring MGP
For trails where the use of a certified MGP is mandatory, the maximum participant ratio shall be
1:7. This means 1 MGP for every 7 participants, including the trip organizer or client (if participating).
ii. Areas Where MGP is Optional
The respective state-level MGP Association may determine the minimum and maximum number of participants per MGP according to local regulations. Typically, a ratio of
1:10 will be applied for standard groups.
This policy ensures that all hiking trips under JomHiking maintain compliance with forest authority rules and uphold participant safety at all times.
I) Insurance & Liability:
- All participants will be covered under the Hikers’ Personal Accident (PA) Insurance plan, which provides protection against accidental injury or death as specified by the insurer Read More.
- JomHiking will arrange this on your behalf as part of the booking process.
- JomHiking and its team shall not be held liable for any claims outside the scope of this insurance coverage. All insurance claims must be made directly to the insurance company.
- Participants remain responsible for their own actions during the hike and are required to follow all safety instructions provided by the MGP.
J) Media Consent:
- By participating in JomHiking trips, you grant JomHiking the right to capture, use, and publish photographs or video recordings taken during the trip for promotional, marketing, and documentation purposes.
- Participants who do not wish to be photographed or recorded must notify JomHiking in writing before the trip.
- All media content produced or obtained during the trip shall remain the exclusive property of JomHiking.
- Participants acknowledge that they shall not be entitled to any royalties, compensation, or claims arising from the use of such images or recordings for publicity, promotion, or marketing purposes.
- This clause shall be read together with our Privacy Policy.
K) Required Documentation & Identification
- It is your sole responsibility to possess all valid documentation and identification required for participation. This includes a valid government-issued photo ID (e.g., MyKad for Malaysian citizens, passport for international visitors) and any specific permits or certificates as may be required by local forestry or park authorities.
- You are solely responsible for:
- Ensuring all your documents are valid, accurate, and presented upon request.
- Any and all costs, losses, or penalties incurred due to missing, invalid, or defective documentation.
- JomHiking provides logistical support for obtaining mandatory forestry permits and insurance as part of your booking.
- However, we do not provide advice on general travel documents (such as visas for international travel to Malaysia) and make no representations or warranties regarding the accuracy of such information.
- You agree that JomHiking is not liable for any errors, omissions, or consequences arising from your failure to secure proper documentation.
6. Cancellations & Refunds
- Cancellation policies will be stated clearly for each trip and are trip-specific.
- Refunds (if applicable) will be processed within a specified number of working days.
- JomHiking reserves the right to cancel or reschedule trips due to safety, weather, or operational reasons. Participants will be informed promptly.

7.
Force Majeure
JomHiking shall not be liable for any failure to perform, or for any delay, change, or cancellation of a hiking trip, resulting from events or circumstances beyond its reasonable control (a "Force Majeure Event"). Force Majeure Events include, but are not limited to:
- Extreme or adverse weather conditions.
- Natural disasters (e.g., earthquakes, landslides, floods, wildfires).
- Acts of government, official restrictions, or sudden regulatory changes (including trail closures by the Forestry Department.
- Political unrest, civil disturbances, terrorism, or war.
- Epidemics, pandemics, or public health emergencies.
- Strikes, lockouts, or labour disputes.
- Major transport failures, road closures, or infrastructure breakdowns.
- Any other unforeseeable and exceptional event outside JomHiking's control.
In the event of a Force Majeure occurrence:
- Cancellation Before Trip Start: A full refund will only be issued if JomHiking cancels the trip entirely before commencement and no alternative is provided. Otherwise, rescheduling will be the primary remedy.
- Disruption After Trip Start: If a Force Majeure Event disrupts the hike after it has begun, no refund will be issued for the portion completed, as guides, permits, and logistics will have been utilized.
- Customer Responsibility: Any additional costs incurred due to a Force Majeure Event (e.g., alternative transportation, evacuation, accommodation, meals) are the sole responsibility of the participant.
- Assistance: JomHiking will, where reasonably possible and safe, assist in making alternative arrangements or facilitating a safe conclusion to the trip. Any such arrangements are subject to availability and may be at the participant's expense.
By booking with JomHiking, you acknowledge and accept the inherent risks of outdoor activities and that Force Majeure Events, while rare, may disrupt or alter the planned itinerary without entitling you to a full refund under all circumstances.
8. Intellectual Property
- All content, branding, and materials on the JomHiking platform remain the property of JH Outdoor Venture.
- Users may not use JomHiking’s logo, brand, or content without written consent.
9. Disputes
- Any complaints or disputes must be submitted in writing to support@jomhiking.com.
- JomHiking will review and respond within a reasonable timeframe.
- These Terms & Conditions are governed by the laws of Malaysia.
